Terms of Service

Version 1.2

1. Who you are buying from

CyberStudios (registration K2021624299) supplies this website, the Bazaar shop, hosting-related services, and professional work we agree with you in writing. We are not VAT registered; where the law asks us to say so, prices are shown as VAT not applicable under South Africa’s Electronic Communications and Transactions Act.

Address: [YOUR_STREET_ADDRESS], [CITY], [PROVINCE], South Africa. Email: [email protected]. Website: https://cyberstudios.co.za

2. What we sell

We sell our own indie games, digital add-ons, subscriptions, merchandise, and packaged digital services (for example website build packages listed in the shop). Separately we may sell or provide hosting, domains, VPS, website and software development, audits and SEO help, and mobile apps—sometimes through the shop, sometimes through a quote or order you sign. We do not build custom games for clients; game development for hire is outside our scope.

Physical goods ship within South Africa only. Digital goods may be sold worldwide unless a law blocks us. What you see on the product page is part of the contract.

3. Buying services and products

Checkout rules, delivery, refunds, and project billing are explained in our Returns & Refund Policy and any quote or statement of work you accept. You must pay on time; we may pause work or access if invoices are overdue, after notice where reasonable.

4. Your account

Keep your login details private. You are responsible for what happens under your account unless you tell us it was compromised and we can verify it. Give accurate contact and billing information. We may suspend or close accounts that break these terms or our Acceptable Use Policy (especially important for hosting and VPS customers).

5. Service availability

We aim for reliable hosting, shop, and support, but we do not promise 100% uptime. Maintenance, upstream provider faults, security events, or force majeure can cause interruptions. Where a paid SLA exists in writing, that document controls; otherwise we fix problems as quickly as we reasonably can during business hours.

We may change features, retire old plans, or update software for security. We will give reasonable notice when a change materially affects you, unless an emergency fix is required.

6. Acceptable use

Hosting, VPS, email, and network use must follow our Acceptable Use Policy. Serious or repeated abuse can lead to suspension without refund for the abusive portion of the service, where the law allows.

7. Intellectual property

Our branding, site text, games, code we write for ourselves, and shop assets belong to CyberStudios or our licensors. A purchase gives you only the rights described on the product page or in our License Policy (for software and digital products).

8. Cooling-off (South Africa ECT Act)

For some online purchases you may have seven business days to change your mind under the ECT Act, with exceptions the law sets out. Once a digital item is delivered or downloaded, or a licence key is revealed, that right often no longer applies unless the product is faulty or the CPA says otherwise.

9. Limitation of liability

To the extent South African law (including the Consumer Protection Act) allows, we are not liable for lost profits, lost data where you did not keep backups, or other indirect damages arising from use of the services. We remain liable for things the law says we cannot cap—such as gross negligence or intentional wrongdoing.

10. Law and disputes

These terms are in English and follow the laws of South Africa. Courts in Gauteng have primary jurisdiction, without taking away any fixed consumer rights you cannot contract out of. We prefer to resolve disputes in good faith and, if needed, mediation before litigation.

Consumer complaints may also be referred to the National Consumer Commission where applicable.
